The interactive process is essential to ADA compliance. Learn how to navigate accommodation requests professionally and legally.
Understanding the Interactive Process
The Americans with Disabilities Act (ADA) requires employers to provide reasonable accommodations to qualified individuals with disabilities. The 'interactive process' is a collaborative dialogue between the employer and the employee to identify effective solutions.
Steps in the Process
- Initiation: When an employee requests accommodation, document the conversation.
- Assessment: Determine if the employee has a qualifying disability and what limitations exist.
- Reasonable Accommodations: Discuss potential adjustments, which could include modified equipment, schedule changes, or task reallocation.
- Implementation & Follow-up: Put the agreement in writing and check in periodically to ensure the solution is working.
Avoid the temptation to guess what an employee needs. Rely on medical documentation where appropriate and focus strictly on whether the accommodation enables the employee to perform the essential functions of their job.
